Directive of Ankara University Research Center on Intellectual and Industrial Property Rights

 Definition

Article 1-Research Center on Intellectual and Industrial Property Rights, which is under the high authority of the Vice-Rector has been founded by this directive according to the d (2) of article 7 of Law numbered 2547.

 Aim of the Research Center

Article 2– Aim of the ResearchCenter is expanding and promoting the use of intellectual and industrial property rights, creating a public consciousness on protecting the culture of intellectual and industrial rights and contributing in the preparation the legal infrastructure for the industry.

 Field of Task

Article 3-Research Center performs the following tasks in order to fulfill its aim:

a)Preparing and applying research projects, contributing and supporting researches and projects in its field of interest,

b)Organizing national and international conferences, congress, symposiums,

c)Organizing long and short term courses and  professional and educational training programs to provide proficiency,

d)Providing consultancy services for public and private sectors with or without charge,

e)Publishing scientific reports, bulletins, books, journals and etc.,

f)Cooperating with the international and national organizations,

g)Performing other tasks that are requested by the authorized departments and commissions of the university

Central Board
Article 5– Central Board consists of the following members that are chosen for three years term. If a member resigns prior to the expiry of his/her term, a new member will be chosen in the same way in order to complete the other member’s term of office.  Members, whose term is expired, may be chosen again. Director and co-directors of the Center are ex officio members of the central board.

a)5 members chosen from academic members of the university by the Executive Board of the University,

b)3 members chosen from academic members of Faculty of Law by the Executive Board of the Faculty of Law,

c)1 member chosen by Ministry of Industry and Trade,

ç)1 member chosen by State Planning Organization,

d)1 member chosen by Turkish Patent Institute,

f)(Amended by O.J.13/05/2001 numbered 24401) 1 member chosen by Ministry of Justice,

g)(Amended by O.J.13/05/2001 numbered 24401) 1 member chosen by Ministry of Agriculture and Rural Affairs,

h)(Amended by O.J.13/05/2001 numbered 24401) If Executive Board of the Center considers necessary, 3 members will be chosen for 3 years term by the public and private sector related to the determined subject.

Meeting of the Central Board and Its Duties
Article 6- (Amended by O.J.13/05/2001 numbered 24401) Central Board shall meet with simple majority of the members at least once in a year upon a convocation by the Director of the Center. Meeting shall be chaired by the Director of the Center or, in the absence of Director by the Co-directors of the Center. Decisions shall be made by the simple majority of the members who participate to the meeting.

Article 7– Central Board shall perform following duties:

a) Giving advice to the Executive Board on the annual activities, research projects, training projects and the programs of the next year which is prepared by the Director and accepted by the Executive Board,

b) Giving advice to the Executive Board on research and training projects,

c) Evaluating the projects which have been already completed or carried out and the activities which are planned,

ç) Electing 2 members to the Executive Board among its members.

Executive Board

Article 8– Executive Board consists of the following members:

a) Director of the Center

b) 2 members elected by Central Board

c) 2 members chosen from academic members of Faculty of Law by the Executive Board of the Faculty of Law

Director of the Center is also head of the Executive Board. Terms of office of the Executive Board members are three years. Members whose term is expired may be chosen again in the same way. If a member resigns prior to the expiry of his/her term, a new member will be chosen in the same way in order to complete the other member’s term of office.

Meeting of the Executive Board and Its Duties

Article 9– Executive Board shall meet at least once in two months upon a convocation by the Director of the Center. Meeting quorum of the Executive Board is simple majority of the membership and decisions shall made by the simple majority of the members who participate to the meeting.

Article 10- Executive Board shall fulfill following duties:

a) Making decisions about the actions of center,

b) Evaluating the proposals that are prepared by the Director and deciding about them,

c) Expressing an opinion on the budget proposal that is prepared by the Director,

ç) Approving the annual reports of the center,

d) (Amended by O.J.13/05/2001 numbered 24401) Working on collecting studies on intellectual and industrial property rights in electronic form and evaluating recommendations and opinions about it.

Director of the Center

Article 11– Director of the Center is appointed among the academic members of faculty of law by Rector. Director whose term is expired may be appointed again. If the Director can’t be on duty more than six months, his/her duty will be expiry automatically. If the Director resigns prior to the expiry of his/her term, a new Director will be appointed in the same way by Rector in order to complete the Director’s term of office.

Director shall appoint maximum two co-directors among the academic members of faculty of law. Co-director shall chair the meetings in the absence of the Director. Term of office of co-director is maximum 3 years. New co-director shall be appointed in the same way in order to replace, in the case of resigning the co-director prior to the expiry of his/her term.

Duties of Director of the Center

Article 12– Director of Center shall perform the following duties

a) Chairing the Central Board and Executive Board,

b) Implementing the decisions adopted by Execution Board

c) Reporting the projects and actions of the Center to the Rectorate at the end of each year,

ç) Informing the Rectorate about the need of appropriation and staff with reasons, submitting the budget to the Rectorate which is prepared by the Director after it is presented to the executive board for its opinions,

d) Performing the general duty of supervising and controlling the staff of the center

 Incomes and Budget of the Center

Article 13– Following sources are incomes of the center:

a) Appropriation that is separated from the budget of the university,

b) Incomes from courses, seminars, training activities, research projects, other services and publications,

c) Incomes from the consultancy services that are provided to public and private sectors,

ç) Any subventions, gifts and bequests.

Article 14- Budget of center is determined as a “Budget of Research Center on Intellectual and Industrial Property Rights” every year within the budget ofAnkaraUniversity.

Article 15- Chief of disbursement of the Center is Rector. Rector may delegate his/her entire or part of power to the Director of the Center.

Date of Effect

Article 16- This Directive will come into effect on the date it is published.

Enforcement

Article 17- The provisions of the directive will be enforced by the Rectorate of Ankara University.
